Scope of Limited Warranty
Boulevard Labs, Inc. (“Boulevard”) warrants your Boulevard Duo (“Hardware”) will be free from substantial defects in materials and workmanship under normal use for a warranty period of twelve (12) months from the date of shipment (the “Warranty Period”). If you discover a defect in a Hardware during the applicable Warranty Period, and notify Boulevard by contacting Boulevard Customer Support (“Customer Support”), Boulevard will, at its option, either (i) employ commercially reasonable efforts to repair, correct or provide a workaround, or (ii) ship a replacement Hardware with a same or similar model, which may or may not be a refurbished one at no additional cost for the hardware, subject to the terms hereof. Any replacement hardware will be warranted for the remaining duration of the original Warranty Period, or thirty (30) days, whichever is longer. This Limited Warranty is not applicable to the Hardware that has been subject to alteration, abuse, negligence, accident, misuse, loss, theft, abnormal wear-and-tear, tempering, fire, improper transportation, installation, disassembly, repair, acts of god (including, without limitation, earthquake, hurricane, flood, lightning or tornado), or other modification by anyone who is not specifically authorized by Boulevard.
Prior to returning the Hardware to Boulevard, you must contact a Customer Support representative to receive a Return Material Authorization (RMA) number (see RMA procedure below). Boulevard reserves the right to refuse returns attempted after thirty (30) days following the date an RMA number is issued, and/or any returns that do not meet the criteria described herein.
Return Material Authorization Procedure
If a Hardware has not been used and is being returned for a refund, it must be in new condition accompanied by all original packaging, documentation, and accessories.
All Hardware returns must be accompanied by a RMA number issued by the Customer Support team. Any products returned without the RMA number may be rejected and returned to the original shipping address. If a Boulevard Customer Support Representative has issued you an RMA number, Boulevard will employ commercially reasonable efforts to ship an advance replacement product via regular ground service by the next business day. You may request shipping methods other than regular ground service at their own cost and expense. If an RMA request is properly filed and received by Boulevard before 3 p.m.pacific time, Boulevard will employ commercially reasonable efforts to ship via regular ground service on the next business day. Customer must return the defective Hardware to Boulevard, to the return address provided below, within thirty (30) days following the date an RMA number is issued (“Return Period”. If Boulevard receives the covered Hardware after the Return Period, or the shipment is incomplete, Customer acknowledges and understands that Boulevard will charge Customer the then-current list price of the advance replacement part, plus shipping costs. RMAs are valid for 30 days from the date of issuance. All returned products must be shipped to Boulevard with proper packaging so as to ensure safe and secure transportation. Risk of loss shall remain with you during shipping.
If you ordered a Hardware that you no longer need, you may return it for a refund. Boulevard only accepts returns within the first 30 days of you receiving the Hardware.
Any returned Hardware that is found to be neglected, abused or otherwise tampered with will not be considered for repair or return and charges may apply. Any product that is returned as defective that is not found to be defective by Boulevard will be retested, certified and returned to you. Any Hardware not covered by this Limited Warranty will be repaired or replaced at Boulevard’s then-current standard rates. Boulevard, in its sole discretion, may repair the applicable Hardware or replace it with an equivalent Hardware, or credit your purchase. Except as provided for herein, and in the master services agreement, Boulevard makes no other warranties express, implied or statutory in connection with the Boulevard Duo or services. All other warranties as to quality, condition, merchantability, fitness for a particular purpose or non-infringement are expressly disclaimed. This section represents Boulevard's sole liability, and your sole and exclusive remedy for any and all claims for breach of this warranty.
